Terms of Use and Sale
The terms on which Africa Recovery Initiative operates this website and sells tree-planting and recovery services.
1. Who we are
This website is operated by Africa Recovery OÜ (“ARI”, “we”, “us”), a company registered in the Republic of Estonia.
- Registered name: Africa Recovery OÜ
- Registry code: 17605799
- Registered address: Sakala tn 7-2, 10141, Tallinn, Estonia
- Email: info@africari.org
We are a commercial company, not a charity. Payments made on this website are purchases of a service, not charitable donations, and they do not qualify for any charitable tax relief. Please read section 3 carefully, because it defines exactly what we undertake to do for the price you pay.
2. These terms
By using africari.org you accept these terms. Orders are governed additionally by our Refunds, Cancellation and Right of Withdrawal policy, and personal data by our Privacy Policy. If you do not accept them, please do not use the site or place an order.
3. What we sell
We sell services performed on your behalf in the field, priced in shares or units so that the amount you pay corresponds to identifiable work:
- Plant a Tree — we raise, plant, protect and water one drought-adapted tree per unit purchased, and report on it.
- Water Point Share — one share towards the construction of a solar-powered community water point.
- Clinic & School Kit Share — one share towards equipping a rehabilitated clinic room or classroom.
Each product page states what is included, what you receive, and the limits of what we promise. Those statements form part of the contract between us.
What a purchase is not: it does not transfer ownership of any tree, seedling, plot, borehole, equipment or building; it does not create an interest in land; it does not make you a shareholder, member or partner of ARI; and it is not an investment, and carries no financial return.
4. Prices, currency and taxes
- Prices are shown and charged in United States dollars (USD). If your card is issued in another currency, your bank sets the exchange rate and may add a conversion fee we neither receive nor control.
- Prices shown are the total payable at checkout; no further taxes or fees are added at checkout.
- We may change prices at any time. The price that applies to your order is the one displayed when you place it.
- On your card or bank statement, the charge appears as AFRICARI.ORG.
5. How a contract is formed
Your order is an offer to buy. The contract comes into existence when we send you the order confirmation email; if we cannot accept your order we will tell you and refund any payment in full. We may decline an order where the product is unavailable, where we suspect fraud or unauthorised card use, where accepting it would breach sanctions or anti-money-laundering rules, or where there has been an obvious pricing error.
6. Delivery and performance
- Nothing physical is shipped. Every product is a service we carry out in the field, evidenced by a digital certificate or confirmation sent to your email.
- Your certificate or confirmation is issued within 5 business days of payment.
- Field work follows the seasons and the security situation. Planting takes place in the next viable planting season; construction and equipping begin when a site is fully funded.
- If we cannot perform the service within twelve months of your order, you may choose a full refund or reassignment to another site, and we will contact you to ask which you prefer.
7. Your right to cancel
If you are a consumer in the European Union you have a statutory right to withdraw from a distance contract within 14 days, and we apply the same right to every customer wherever they live. The details, including how to exercise it and the model withdrawal form, are in our Refunds, Cancellation and Right of Withdrawal policy.
8. Acceptable use of the website
You may read, quote with attribution, and share our published material. You may not attempt unauthorised access to the site or its accounts; probe, overload or disrupt it; submit false or fraudulent information or use stolen payment credentials; harvest personal data; use our name, logo or materials to solicit money or claim affiliation without our written authorisation; or upload unlawful, infringing or malicious content. We may restrict access where we reasonably believe these terms have been breached.
9. Intellectual property
Unless stated otherwise, the text, design, photographs, illustrations, logos and reports on this site belong to ARI or are used with permission. You may reproduce short extracts for non-commercial reporting, research or teaching with credit to “Africa Recovery Initiative”. Any other reproduction requires written permission.
About the imagery: photographs and illustrations on this site represent the kind of work our programmes carry out and the contexts in which they operate. They do not identify specific individuals and are not presented as documentary evidence of a particular event, place or date. Where an image accompanies a stated result, the accompanying text is the authoritative statement.
10. Programme figures
Targets, scales, phases, dates and budgets published on this site — tree counts, hectares, beneficiary numbers, funding goals — are plans and estimates, not guarantees. They depend on orders received, access, security, weather and the decisions of local authorities and partner communities. Any figure shown as illustrative or demonstration data is labelled as such and must not be read as an actual result.
11. Liability
We provide the website “as is” and do not warrant that it will be uninterrupted or error-free. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded, and nothing affects the mandatory statutory rights of consumers — including the right to a service performed with reasonable care and skill. Subject to that, we are not liable for indirect or consequential loss, and our total liability in connection with an order is limited to the amount you paid for it.
12. Complaints and disputes
Write to info@africari.org. We acknowledge complaints within 2 business days and aim to resolve them within 14 days. If we cannot, consumers resident in the European Union may refer the matter to the Estonian Consumer Disputes Committee (tarbijavaidluste komisjon) through the Consumer Protection and Technical Regulatory Authority, or to the equivalent body in their own country.
13. Governing law
These terms are governed by Estonian law, and disputes fall to the Estonian courts, with Harju County Court as the court of first instance. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of your country of residence, nor of the right to bring proceedings there.
14. Changes
We may update these terms as the business and the law change. The version in force when you place an order is the one that governs it.
